These Terms of Use ("Terms") govern your use of the heysenior.com website and of the Shopify apps developed by HeySenior ("HeySenior", "we", "us"), including HS Slide Cart Drawer Upsell, Filtor Search & Filter and Ticart: Cart Countdown Timer (each an "App"). By installing or using an App, you ("you", "the merchant") agree to these Terms. If you use an App on behalf of a business, you accept them on behalf of that business.
1. The Apps and Shopify
The Apps run on Shopify's platform and are installed from the Shopify App Store. Your use of Shopify is governed by Shopify's own terms. Some features depend on Shopify's services and APIs; if Shopify changes or interrupts them, the related features may change or stop working.
2. Your account and eligibility
You must have a Shopify store and the authority to install apps on it. You are responsible for the activity carried out through your store's installation of an App, including the settings you configure.
3. Plans, billing and free trials
- Paid plans are billed by Shopify through its billing system and appear on your Shopify invoice. Plans may include a recurring fee, usage-based charges (for example, based on the number of orders the App took part in during each billing cycle) or both, as described in the App's pricing when you approve the charge.
- Free trials, when offered, end on the date shown when you approve the plan. Charges start after the trial unless you uninstall the App or change to a free plan before it ends.
- You can change or cancel your plan at any time from the App or by uninstalling it. Charges already billed are not refunded, except where required by law or where we decide to grant a refund or credit.
- We may change our prices. We will give you reasonable notice before a change applies to your plan, and Shopify will ask you to approve any new charge when its approval is required.
4. Your responsibilities
- You are responsible for the content, products, prices, discounts, rewards, translations and other settings you configure in an App, and for checking that they work as you intend in your store and at checkout.
- You must comply with the laws that apply to your store, including consumer protection, advertising and privacy laws, and inform your customers in your own privacy policy about the apps your store uses.
- Optional paid add-ons (such as shipping protection or gift wrap) are offered to buyers and added to the cart only with the buyer's action, as Shopify's App Store requirements require.
5. Acceptable use
You agree not to: copy, modify, reverse engineer or resell an App; access it in a way that circumvents its billing or limits; use it to send unlawful, misleading or harmful content; interfere with its security or operation; or use it in any way that violates Shopify's terms or the law.
6. Data and privacy
We process your store's data only to provide the Apps, as described in each App's privacy policy (all of them are listed in our Privacy Policy). For the personal data of your customers that passes through an App, you are the controller and we act as your processor: we process it only on your behalf and following your instructions as expressed through the App's settings, we keep it confidential, we apply the security measures and retention periods described in the App's privacy policy, and we delete it after you uninstall the App as Shopify's privacy requests require.
7. Intellectual property
The Apps, the website and their content are owned by HeySenior and protected by intellectual property laws. While your installation is active and you comply with these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Apps in your Shopify store. You keep all rights to your store's content. If you send us suggestions, we may use them without any obligation to you.
8. Third-party services
Some features work with third-party apps and services (for example, subscription or review apps). Their use is governed by their own terms, and we are not responsible for them.
9. Changes, availability and support
We improve the Apps continuously and may add, change or remove features. We aim to keep the Apps available, but we do not guarantee that they will be uninterrupted or error-free. Support is available by email and through our Helpdesk.
10. Disclaimer
To the extent permitted by law, the Apps are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee any particular sales, conversion or revenue result.
11. Limitation of liability
To the extent permitted by law, HeySenior will not be liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data, arising from the use of the Apps or the website. Our total liability for any claim related to the Apps is limited to the fees you paid us for the App concerned in the twelve (12) months before the event that gave rise to the claim.
12. Indemnity
You agree to indemnify HeySenior against claims by third parties arising from your store, your settings and content in an App, or your breach of these Terms or of the law.
13. Termination
You can stop using an App at any time by uninstalling it. We may suspend or end your access to an App if you breach these Terms, if required by Shopify or by law, or if we discontinue the App, with notice when reasonably possible. After uninstallation, your data is deleted as described in the App's privacy policy.
14. Changes to these Terms
We may update these Terms. We will publish the new version on this page with its date and, for significant changes, inform you inside the App or by email. Continuing to use an App after a change takes effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the country where HeySenior is established, without regard to its conflict of laws rules, and without depriving you of any protection that mandatory law gives you.
